Why Should You Read This?

Millions of dollars in rent refunds are awarded to tenants every year. Many more refunds are never recovered because tenants are not aware that they are overcharged, and then allow their claims to expire. The most recent comptroller's report estimated that the pending rent overcharge complaints on file would result in $69 million dollars of valid claims.

Every rent stabilized or rent controlled tenant in New York State should read this primer and verify that his/her rent is legal.

A rent overcharge case is one of the most common types of actions, yet commonly misunderstood. The largest misconception is that a rent overcharge case is simple and straightforward. Uninformed tenants often fight their overcharge cases for several months before they realize just how complicated an overcharge case can be.

To be forewarned is to be forearmed. This primer helps New York tenants discover whether they are being overcharged, what is involved in an overcharge case, and what to do about it.
